Edupics
End User Licence Agreement (5th Jan 2011)
1.
Your Edupics password
You, the
User, may not permit anyone else to use your individual Edupics password. If
you become aware of theft or misuse of your password, you must inform us in
writing immediately, otherwise you may be liable to us for loss or damage
arising and you may be prohibited from accessing our Site again.
For
access to the Pupil Edition one password per year group will be issued and
access will be granted by entering this password in conjunction with each
studentÕs name and year.
2.
Logging out of Edupics
At the
end of a session please ensure that you log out of the Edupics system to avoid
breaches of security.
3.
What can you use the Content for
Edupics
provides still images, video, audio, text and other content, referred to as
Content. Edupics Content may be accessed by you, an authorised User for
educational and research use, limited to browsing copying and reproduction in
course work, display and presentation within your educational institution.
Edupics
grants you a personal, non-transferable, non-exclusive right to copy Content
from this Site that you have selected on to your computer hard drive and for you
to use the Content for educational use only in accordance with these Conditions
and a signed Agreement with you or your institution. You agree that you do not
acquire any ownership rights by downloading any Image and that all Content
remain the property of Edupics and its Content Providers.
4.
What you can't use the Content for
Edupics Content cannot be used for any promotional use (for
example, prospectuses, marketing promotion, advertising, or public relations),
nor for any private or any commercial purpose whatsoever.
Edupics Content individually, or as part of a larger
document, cannot be made public in any way, nor can the Content be distributed
to any other parties, whether for financial consideration or barter or for
free.
5.
Disclaimer
You are
permitted to grant access to the Edupics TeacherÕs Edition website only to
persons over 18 years old in order to avoid the viewing of Content deemed
inappropriate for certain age groups causing distress.
The Pupil
Edition contains an edited selection of images suitable for searching and
downloading by under 18s.
You agree
that Edupics cannot be held liable for any distress or harm which may be caused
by the viewing of EdupicsÕ Content.
Although
Edupics currently has over 500 000 images online, the images do not necessarily
cover every aspect of the curriculum.
6.
Image Credits
Edupics
Content downloaded and used for any purpose must always maintain unaltered
credit, copyright, other proprietary notices, and
embedded links. You are expressly prohibited from removing any data from any
Image.
7.
Termination of the contract
In the
event of non-renewal of the Subscription Agreement, access to Edupics will
cease to be available to you and all Edupics Content that has been stored must
be deleted by you from your computers, laptops, portable reading devices,
mobile phones and all other electronic devices.
(i) Any
Content used in studentÕs coursework throughout the year may be kept only as
part of the coursework.
(ii) Any
lesson plans and other teaching material containing the Content may be kept for
historical purposes provided it is not used for subsequent yearÕs teaching
purposes.
(iii) If
you wish to re-use the teaching material you may do so subject to Edupics prior
written consent and to the payment of a reduced fee to be negotiated.
8. Subscription
Agreement
Your
educational institution (and in certain rare cases you) will be subject to and
bound by the full conditions of the Subscription Agreement which your
institution (or you) entered into with Edupics.
The
Teacher Edupics password will remain active until the subscription period has
come to an end, or the agreed number of images has been downloaded, whichever
comes first.
The Pupil
Edition passwords will remain active as long as the schoolÕs Teacher Edition
download limit has not been reached.
To avoid
misuse of the Edupics service by pupils, a Ôreasonable useÕ policy is deemed to
be approximately 10 times the Teacher Edition limit.
